Hi I was given a limited leave to remian valid upto 2011 based on awork permit in 2006. I have since moved on and worked for another company for 2 years during which I did not renew my leave to remain, instead my employer renewed the work permit/employment document 3 times. The company has now been taken over and adviced me to make a tier 2 application. what is my legal standing, as ive stopped working and the company state I have no valid leave to remain, and have worked illegally over the last 1.5 years. what is my legal standing and my current imigration status? I am a pharmacist by profession.

If you have been working without valid leave for over 1.5 years and you have not made any applications to the Home Office you will not be able succeed in an application under the teir system as this requires you to have legal leave to remain in the UK.
You will need to return to your Country of origin.However because you have overstayed more than 28 days you will be banned from submitting any further work type applications for at least a period of one year.

First of all it is possible for you to return to your country of origin and make an application. the length of time it takes depends the backlogs at the British High Commission but we usually advise that it can be between 3-6 months. also you will need to take into account that if the application is refused then you will have to appeal and this can take upto a further 6 months before the process is completed.
with regrads to whether the application will be affected with the tax creditts, it is a very grey area but it will be taken into account by the Entry Clearance Officer.
another option for you maybe to also make an application to the Home Office asking for permission to work.

The main requirements for applying for Naturalisation is that the person has had five legal years in the UK and at least one of these years has been in the form of Indefinite Leave to remain. this is diffferent if he obtained his leave as a spouse. in such a case he will require 3 years of legal stay in the UK and 1 of those years has to been in the form of Indefinite leave to remain. if he can meet this then he need to fill out the Naturalisation form and send it to the Home Office. the is a limit to the number of days that he has been out of the UK. if you have any problems please do not hesitate to contact Davy Bal Solicitors who can assist you with this matter.

when an Entry Clearance application has been refused it can be appealed within 28days of recieving the refusal.

I came here as a student in 95, had student visa extensions till 2000, was unlawful till 2005, been on discretionary leave for 4 yrs, was never issued a deportation order, got married in 2002 to a British lady, still married. If you have been in the UK lawfully or unlawfully for 14 years and have never had an enforcement notice issued against you then you would be eligible to apply under the 14 year long residence rule.
You will need to provide the Home Office with documentary evidence that you have been in the UK for that period of time. also you will need to show that you can maintain and accommodate yourself.
I would advise you to get a representative to submit your application so that they can explain your circumstances to the Home Office.

I have two daughters born August 2000 and september 2002 we are currently in botswana

in the UK. they are entitled to do that. Your application will not have been effected
by the change in law which will take place in October. Your options at this stage

your husband will need to be able to show that you can be maintained and accommodated

You can make an application for fresh claim but you will have to provide evidence
that has not been considered by the Home Office before otherwise it will not be
accepted as a fresh claim.

I have three children who are british citizens and my wife have an indefinate leave
in the UK. I applied for regularisation of my stay based on the 14yrs rule and also
as a spouse of a settled person in August 2006. The solicitor who was dealing with
the case charged £1200 one off payment and I also paid £335 to the home office
for the application. The home office sent a reply in September that my application
has been sent to a case worker who will be dealing with it. Last year my solicitor
contacted the home office why they have not made a decision regarding my application.
The home office replied that due to the large volume of similar applications, they
have not been able to make a decision on my application, they also advise us not
to contact them again as this may delay my application. In January this year, my
solicitor wrote me that because it was sixteen months since they submitted my application
and there has been no decision from the home office, I should send him £495 in
order to write my local MP to get him involve in my case. Should I agree with this
advise? The home office had already sent a letter last year that we should not contact
them until we hear from them as this may delay my application. Can you please advise

We would always advise that you should actively pursue the Home Office for a decision.
However if you had agreed a fixed fee with your solicitor to complete the matter
for you then it would seem unreasonable for them to chargr more fee's You should

I’m afraid the Home office are very slow but time is on your side and having dependant
children will secure your stay here. Don’t hesitate about going to Social Services
for help with your housing but in the meantime you shouldn’t leave your present
home unless and until there is a court order requiring you to do so, if you get
a possession order against you you can always go back to the court which made it,
explain your problem and you should get further time.

that you status in the UK can effect this in Ireland

You are free to go and stay with him. However if the matter is not reconsidered
by the entry clearance officer and it goes to an appeal hearing here in the UK then
you should return so that you can give evidence at the hearing.
