the Entry Clearance Officer will have taken into account the time that you spent in the UK. they are entitled to do that. Your application will not have been effected by the change in law which will take place in October. Your options at this stage would be to appeal the decision or to make a fresh application. this will depend on whether she changed her status to that of a spouse. If she did not then she can apply after 5 years of being here as a dependant of a work permit holder in line with her father. If she did change her status to that of a spouse then she will have to wait 2 years from the time that she was granted her stay as a spouse before she can apply for indefinite leave to remain. |

The Ho replied to say my application was valid and would get back to me within 12 weeks. Since then I have not heard anything. We have a british baby daughter and we are expecting another in May. I hv contacted the MP George Mudie and who has taken this on board. The last letter I received form the Ho said that my case was still awaiting to get a case worker to deal with it. You can make an application for fresh claim but you will have to provide evidence that has not been considered by the Home Office before otherwise it will not be accepted as a fresh claim. |

I have three children who are british citizens and my wife have an indefinate leave in the UK. I applied for regularisation of my stay based on the 14yrs rule and also as a spouse of a settled person in August 2006. The solicitor who was dealing with the case charged £1200 one off payment and I also paid £335 to the home office for the application. The home office sent a reply in September that my application has been sent to a case worker who will be dealing with it. Last year my solicitor contacted the home office why they have not made a decision regarding my application. The home office replied that due to the large volume of similar applications, they have not been able to make a decision on my application, they also advise us not to contact them again as this may delay my application. In January this year, my solicitor wrote me that because it was sixteen months since they submitted my application and there has been no decision from the home office, I should send him £495 in order to write my local MP to get him involve in my case. Should I agree with this advise? The home office had already sent a letter last year that we should not contact them until we hear from them as this may delay my application. We would always advise that you should actively pursue the Home Office for a decision. However if you had agreed a fixed fee with your solicitor to complete the matter for you then it would seem unreasonable for them to chargr more fee's You should discuss the matter with them. Also you can personally contact your MP without your solicitor getting involved. |

My Husband has been refused a settlement visa on the ground that they do not feel that our reltionship is real we have been together since August 2005 and married 2007 in Jamaica. They also refused the visa n the grounds that the accomodation is over crowded . It is a three bedroom property and the tenancy agrement states that no more than 7 people to live within the property. Hi there. I came into the country in 2003 on a visitor’s visa. I then took up studies, and therefore got a student visa. In 2005 I got a work permit visa, which expires in December 2008. April 2008, I will be three years in the country. My enquiry is to see if I can apply for an indefinite leave to remain or if I have to be five years on a work permit. Please advise. I’m not an immigration specialist but I think you may be in trouble. There’s a real danger that you go back home and won’t be allowed back. You should go to a specialist adviser.

hi, i applied for my husbands visa in oct 07 and it got refused. the reason why there refused it is because the house asassment report but not right it had a lack of info, and there were 2 other things missing now i have made an appeal from here i have sent the supporting documents which clear the objections, they said they wil review the case. i wanted to ask u that now they wil review my case so can they ask for any other documents or my payslips or bank statements? and i have sent everything that was needed so what are the chances to get the visa? and how long will it maxium take to review my case? by sanam |

You are probably in the clear now by sending in the missing documents. These things take a long time and they may ask for more documents etc if they do comply with their requests. |

If you are British you can get married here even if your partner is not. Marriage doesn’t of itself allow your partner to stay if the terms of the visa have been breached |

I’m not an expert on invalidity benefit but can’t see why you should lose it if you marry and stay here. If yuou go to Jamaica I expect you will lose your benefit and have to pay back the student loan |

I am a single parent with 3 children under 16. \r\n\r\nI applied for Indefinite Leave to Remain under the 14 years long residency rule (I came to the UK 17 years ago) almost 2 years ago. I am still awaiting decision. \r\n\r\nHowever my 3 children under 16 have been registered as British citizens by the Home Office.\r\n\r\nFollowing further letters and phone calls to the Home office re the delay in processing my claim, we received a letter from the Home Office advising us not to write or phone them again regarding my application until I receive a decision from them. \r\n\r\nI am a bit worried about this. Please advice.\r\n\r\nMoreso, my landlord is in the process of repossessing my home. The court order requires us to move out of the property by the end of this month. \r\nI have been looking for alternative accommodation but the prospective landlords wants a copy of my passport / immigration documents before they can consider me for the prospective properties available - I cannot provide the documents they want. I am scared of being homeless. \r\n\r\nAs a result I sought advice from the Citizens Advice Bureau and was advised that even though I have no recourse to public funds, the Social Service should be able to assist me for the sake of my children. They advised me to contact the Social Services but I am scared of contacting them in case doing so ends up having an adverse effect on my application at the Home office. I’m afraid the Home office are very slow but time is on your side and having dependant children will secure your stay here. Don’t hesitate about going to Social Services for help with your housing but in the meantime you shouldn’t leave your present home unless and until there is a court order requiring you to do so, if you get a possession order against you you can always go back to the court which made it, explain your problem and you should get further time. |

Hi there, My mum was granted live to remain on the basis of long stay after 14 years. During that time she had picked up a criminal record, which will be spent on the 10th of next month (after 10 yrs). when my lawyer put in application for the family anmesty on my behalf, it was refused because her criminal record wasn’t sent at the time. my question is, shouldn’t they have looked at this as an exception case since the convicted had already been granted stay with full knowledge of her record? When an Entry Clearance refusal is appealed against the Tribunal usually give the Entry Clearance Officer 3 months to put their case together before a hearing date is set. During this time the Entry Clearance Manager will usually review the decison and it could be overturned if felt he does meet the requirements of the Immigration Rules |

I came to UK in July 1998 and i will be completing 10 years of stay in UK in July 2008. My wife who is an Indian national holding Indian Passport came to UK in Aug.2000. Our son was born in UK in Oct.2002 and holds an Indian Passport.\r\n\r\nLike many overseas doctors working in NHS, i had Permit Free Training (PFT) Visa to start with and then switched over to HSMP in Nov.2005 and now i am on Work Permit valid from Nov.2006 and expires in Nov.2011. \r\n\r\nFrom 10/Sept/2004 until 16/Sept/2005, i took my family to Ottawa, Canada where i trained in University of Ottawa. It was a continuous stay in Canada for 12 months and our home in UK was rented out to pay for the mortgage. This training in Canada was approved at the highest level by Royal College of Anaesthetists in London and my deanery in Newcastle-Upon-Tyne. The deanery granted me unpaid leave for this one year period but continued my pension contributions during my absence.\r\n\r\nMy questions:\r\n\r\nAm i eligible to apply for ILR in July 2008 based on 10 years of stay in UK?\r\n\r\nHow will my stay in Canada for one year for study and training reasons affect my application for ILR?\r\n\r\nMy friends say that my applicaton may be rejected due to continuous absence from UK for 12 months - Is that the case?\r\n\r\nWhat are my true chances of getting ILR if i apply through immigration lawyers/solicitors? What are my chances if i go on my own accord? You will not be entitled to apply for ILR on the basis of long residency in 2008 because you were absent from the UK for over a 6 month period. You can apply for ILR when you have completed 5 continuous years as a work permit holder. |

i came to uk from kurdistan in april 2001 and i have been refused leave to remain. I have also had appeals and they have also been refused. Since coming here, i met my partner who is english ( and we married under islamic law) and we have a 3 year old daughter and my partner has a 7 year old son - who i have raised. we have been together since august 2001. I have been to see solicitors, and after a few years of trying to fight the Home Office, i no longer know what to do. My family have now moved from Kurdistan to Finland, and i am stuck here not allowed to work and support my family - my partner has to work full time to support us. I can not go back to my country, but do not know what do do. I have written to the Home Office and spoken to them more times than i can count. I have even put in complaints and i have been told that it will be investigated, but nothing. My partner and i submitted form FLR ( M ) 3 years ago, under the advice when i phoned the Home Office helpline number and i am still awaiting a decision on this. You would not be entitled to do so under the Immigration Rules so it would be at the discretion of the Secretary of State. Otherwise the only option available would be to make an Entry Clearance application. |

You are free to go and stay with him. However if the matter is not reconsidered by the entry clearance officer and it goes to an appeal hearing here in the UK then you should return so that you can give evidence at the hearing. |
